Terms of Service

Last updated: October 18, 2026

1. About these Terms

1.1 These Terms of Service ("Terms") are an agreement between you and TenderScan ("TenderScan", "we", "us"). They apply whenever you visit tenderscan.ca or use any TenderScan service, including our website, dashboard and emails.

1.2 By creating an account or using TenderScan, you accept these Terms and our Privacy Policy. If you use TenderScan for a business, you confirm you are authorized to accept these Terms on its behalf, and "you" includes that business.

1.3 You must be at least 18 years old to create an account.

2. What TenderScan does

2.1 TenderScan collects public tender and procurement notices from Canadian sources, organizes them, and alerts you when notices match the keywords and regions you choose. It also offers tools to track bids, deadlines, tasks and reusable content.

2.2 TenderScan is a discovery and organization tool. It is not a tendering platform. We do not issue tenders, receive bids, or act for any buyer. To obtain tender documents, receive addenda or submit a bid, you must use the issuing organization's own portal and follow its rules.

3. Tender information

3.1 Where it comes from. Tender information on TenderScan comes from government portals, open-data publishers, public bodies' websites and third-party data providers. Our Data Sources & Attribution page describes these sources.

3.2 The original posting governs. The notice published by the issuing organization is the official version. Titles, dates, locations and other details on TenderScan may be incomplete, delayed or out of date, for example when a buyer issues an addendum, extends a deadline or cancels a tender. Always confirm details on the original posting before you rely on them.

3.3 Automated classification. We use automated tools, including artificial-intelligence models, to classify notices by industry and location and to match them to your keywords. These classifications can be wrong or incomplete. A tender relevant to you may not appear in your matches, and a match may not be relevant.

3.4 No guarantee of coverage. We do not guarantee that TenderScan captures every tender from any source, or that alerts arrive by a particular time. Sources change or become unavailable, and we may add or remove sources at any time.

3.5 Third-party content. Tender notices are written by the organizations that issue them. Names and marks of portals, buyers and other organizations belong to their owners, and their appearance on TenderScan does not mean they endorse us.

4. Your account

4.1 Give us accurate information when you register and keep it up to date.

4.2 Keep your password confidential. You are responsible for activity under your account. Tell us promptly at support@tenderscan.ca if you suspect unauthorized access.

4.3 You may sign in with a Google account. Your use of Google sign-in is also subject to Google's terms.

4.4 Each account is for one person. Do not share login credentials, and do not open several accounts to obtain extra free trials or to avoid plan limits.

5. Plans, billing and free trials

5.1 Plans. TenderScan offers a free plan and paid plans. Current features, limits and prices are shown on our pricing page and at checkout. Paid plan features are available only while your subscription is active.

5.2 Billing. Paid plans are billed in advance, monthly or annually, through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method for each billing period until you cancel. Prices are in Canadian dollars. Applicable taxes, such as GST, HST or QST, are added as required by law.

5.3 Automatic renewal. Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.

5.4 Price changes. We may change prices. We will give you at least 30 days' notice by email before a change applies to your subscription, and it takes effect at your next renewal. If you do not agree, you may cancel before then.

5.5 Failed payments. If a payment fails, Stripe may retry it. If it cannot be collected, we may suspend paid features or move your account to the free plan.

5.6 Free trials. New accounts may receive a free trial of a paid plan. You do not need to enter payment details to start a trial, and nothing is charged during it or when it ends. When the trial ends, your account moves to the free plan unless you have subscribed to a paid plan. Each person or business may use one free trial.

6. Cancellation, refunds and plan changes

6.1 Cancellation. You may cancel at any time from your account settings. Your paid features continue until the end of the billing period you have already paid for, and your subscription then ends without further charge.

6.2 Refunds. Payments are not refundable, and we do not refund partial billing periods, except where required by law.

6.3 Plan changes. You may upgrade or downgrade at any time. If your new plan has lower limits, features or content above those limits, such as additional keywords, saved tenders, regional filters or templates, may be disabled or hidden. Your data is not deleted because of a downgrade, except where you choose to delete it.

7. Acceptable use

You agree not to:

  • copy, scrape, harvest or bulk-download content from TenderScan by automated means, or use TenderScan to build a competing product or database;
  • resell, sublicense or publicly redistribute tender information obtained through TenderScan, except to share individual tenders using the sharing features we provide;
  • share your account, or work around plan limits, trials or usage controls;
  • probe, disrupt or try to gain unauthorized access to TenderScan, other accounts or our systems;
  • reverse engineer TenderScan, except where the law allows it despite this restriction;
  • use the sharing features to send unsolicited messages, or to email people who have not agreed to hear from you;
  • upload anything unlawful, harmful or that you do not have the right to upload; or
  • use TenderScan in breach of any law, including anti-spam and privacy laws.

8. Your content

8.1 "Your content" means what you add to TenderScan: keywords, notes, bid records, library snippets, uploaded templates and similar material. You keep ownership of your content.

8.2 You give us a limited licence to store, copy and process your content only as needed to provide TenderScan to you, to keep it secure and to comply with the law. We do not sell your content.

8.3 You are responsible for your content and confirm you have the right to provide it. Keep your own copies of anything important; TenderScan is not a backup service.

9. Our intellectual property

TenderScan's software, design, text and compilations, and the TenderScan name and logo, belong to TenderScan or its licensors. We give you a personal, non-transferable, revocable licence to use TenderScan for your own business purposes under these Terms. All rights not expressly granted are reserved.

10. Third-party websites and services

TenderScan links to tender portals, buyers' websites and other sites we do not control, and relies on third-party services such as Stripe and Google. We are not responsible for their content, availability or practices, and your use of them is governed by their own terms.

11. Emails and alerts

We send emails needed to run your account, such as verification, security, billing and alert emails. Alerts are a convenience: they may be delayed, filtered by your email provider or missed. Do not rely on TenderScan alone to meet a bid deadline. You may turn off optional emails at any time.

12. Availability and changes to the service

We work to keep TenderScan available but do not promise uninterrupted service. We may carry out maintenance, and we may change, add or remove features. If we discontinue a paid feature in a way that materially reduces your plan, we will tell you in advance, and you may cancel.

13. Suspension and termination

13.1 You may stop using TenderScan and delete your account at any time from your account settings.

13.2 We may suspend or close your account if you materially breach these Terms, if your use creates a security or legal risk, or if required by law. Where reasonable, we will tell you first and give you a chance to fix the problem.

13.3 Sections 3, 7, 8.3, 9, 14, 15, 16 and 17 continue after your account ends.

14. Disclaimers

TO THE EXTENT PERMITTED BY LAW, TENDERSCAN IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DO NOT WARRANT THAT TENDER INFORMATION IS COMPLETE, ACCURATE OR CURRENT, THAT TENDERSCAN WILL MEET YOUR NEEDS, OR THAT IT WILL BE ERROR-FREE. WE DO NOT GUARANTEE THAT YOU WILL WIN ANY TENDER OR CONTRACT.

15. Limitation of liability

15.1 TO THE EXTENT PERMITTED BY LAW, TENDERSCAN IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST CONTRACTS, MISSED TENDERS OR LOST DATA, ARISING FROM YOUR USE OF TENDERSCAN.

15.2 OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO TENDERSCAN IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100 CAD.

15.3 Nothing in these Terms limits liability that cannot be limited by law, or any rights you have under consumer protection law that cannot be waived.

16. Indemnity

If you use TenderScan for a business, you agree to compensate TenderScan for reasonable losses and legal costs arising from your breach of these Terms or your misuse of TenderScan, including content you upload or messages you send through our sharing features.

17. Governing law and disputes

17.1 These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.

17.2 Before starting any claim, please contact support@tenderscan.ca so we can try to resolve the issue informally within 30 days.

17.3 If it is not resolved, the courts of Ontario have jurisdiction, and either of us may bring a claim in small claims court where it qualifies. If you are a consumer, you may also have the right to bring proceedings in your own province.

18. Changes to these Terms

We may update these Terms. We will post the new version with a new "Last updated" date. For material changes, we will email you at least 30 days before they take effect. If you keep using TenderScan after that date, the new Terms apply; if you do not agree, you may cancel before then.

19. General

19.1 These Terms and the Privacy Policy are the entire agreement between you and us about TenderScan.

19.2 If any part of these Terms is found unenforceable, the rest remains in effect.

19.3 Our failure to enforce a right is not a waiver of it.

19.4 You may not transfer your account or these Terms without our consent. We may transfer them as part of a sale or reorganization of the business, and will tell you if we do.

19.5 These Terms are provided in English.
