Please read these Terms of Service carefully before using TenderScan. These terms govern your use of our platform and services.
These Terms of Service ("Terms") constitute a legal agreement between you and Creetos regarding your use of TenderScan. By accessing or using TenderScan, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our service.
By accessing or using TenderScan, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
These Terms constitute a legally binding agreement between you and Creetos (the operator of TenderScan). Your use of the platform indicates your acceptance of these Terms and our Privacy Policy.
We reserve the right to refuse service to anyone for any reason at any time.
TenderScan is a tender monitoring platform that aggregates and monitors Canadian procurement opportunities from various public and private sector sources. Our service provides keyword-based monitoring, notifications, and tools to help businesses discover relevant tender opportunities.
While we strive to provide comprehensive and accurate tender information, TenderScan does not guarantee that all tender opportunities will be captured or that the information provided is complete, accurate, or up-to-date. Users are responsible for verifying all information directly with the tender-issuing organization.
TenderScan is a monitoring and information tool. We do not guarantee that using our service will result in winning tenders, business opportunities, or any specific outcomes. Success in procurement depends on many factors beyond the scope of our service.
We aim to provide uninterrupted service but do not guarantee that TenderScan will be available at all times. The service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We reserve the right to modify, suspend, or discontinue any part of the service at any time.
To use TenderScan, you must create an account by providing accurate, current, and complete information. You must be at least 18 years old and have the legal capacity to enter into this agreement.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other security breach.
You agree to provide accurate information when creating your account and to keep this information up to date. Providing false information may result in account suspension or termination.
Each user is permitted only one active account. Creating multiple accounts to circumvent service limitations or trial periods is prohibited and may result in termination of all associated accounts.
TenderScan offers various subscription plans with different features and limitations. Details of each plan are available on our pricing page. By selecting a paid plan, you agree to pay the subscription fees associated with that plan.
Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. Annual plans are billed once per year on the anniversary of your subscription start date. Monthly plans are billed on the same day each month.
You must provide a valid payment method to subscribe to a paid plan. By providing a payment method, you authorize us to charge all subscription fees to that payment method. Payments are processed securely through our third-party payment processor, Stripe.
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription rate for your plan. We will notify you of any price changes in advance.
We reserve the right to change our subscription prices at any time. Price changes will not affect your current billing period and will take effect at your next renewal. We will provide at least 30 days' notice of any price increases.
If a payment fails, we will attempt to charge your payment method again. If payment cannot be processed after multiple attempts, your subscription may be suspended or downgraded until payment is successful. You remain responsible for any uncollected amounts.
All fees are exclusive of applicable taxes (including GST/HST in Canada), which will be added to your invoice as required by law. You are responsible for paying all applicable taxes.
TenderScan may offer free trials for paid plans. During the trial period, you have access to the features of the selected plan at no charge. Trial periods are only available to new users who have not previously used TenderScan.
At the end of your trial period, your account will automatically convert to a paid subscription unless you cancel before the trial ends. If you provided payment information, your payment method will be charged at the start of the paid subscription period.
Each user is entitled to one free trial. Creating multiple accounts to obtain additional free trials is prohibited and may result in account termination.
You may cancel your subscription at any time through your account settings. Upon cancellation, your access to paid features will continue until the end of your current billing period. No refunds will be provided for partial billing periods.
We offer a 14-day money-back guarantee for first-time subscribers. If you are not satisfied with TenderScan within 14 days of your first paid subscription charge, contact us for a full refund. Refunds are not available for renewals or subsequent subscription periods.
You may downgrade your subscription plan at any time. The downgrade will take effect at the start of your next billing period. No refunds will be provided for the difference between plan prices for the current billing period.
You may use TenderScan only for lawful purposes and in accordance with these Terms. You agree not to use the service in any way that violates applicable laws or regulations.

We reserve the right to investigate and take appropriate action against anyone who violates this Acceptable Use Policy, including removing content, suspending or terminating accounts, and reporting to law enforcement authorities.
TenderScan and all of its content, features, and functionality (including but not limited to software, text, displays, images, and design) are owned by Creetos, its licensors, or other providers of such material and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use TenderScan for your internal business purposes. This license does not include the right to copy, modify, distribute, sell, or lease any part of our service.
You retain ownership of any content you submit to TenderScan (such as keywords and saved searches). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process that content solely to provide you with the service.
The TenderScan name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Creetos. You may not use such marks without our prior written permission.
TENDERSCAN IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, Creetos disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that TenderScan will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.
We do not warrant or make any representations regarding the accuracy, completeness, or reliability of tender information provided through TenderScan. You acknowledge that using TenderScan is at your own risk and that you are solely responsible for verifying all tender information with the issuing organization.
TO THE FULLEST EXTENT PERMITTED BY LAW, CREETOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
In no event shall Creetos's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to TenderScan in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
This limitation applies to all claims, whether based on warranty, contract, tort, or any other legal theory, and whether or not Creetos has been informed of the possibility of such damage. Some jurisdictions do not allow certain warranty disclaimers or limitations of liability, so these limitations may not apply to you.
You agree to indemnify, defend, and hold harmless Creetos, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of TenderScan; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you submit through the service.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada, for the resolution of any disputes arising from these Terms or your use of TenderScan.
Before filing any formal dispute, you agree to first contact us at support@tenderscan.ca to attempt to resolve the dispute informally. We will work in good faith to resolve any disputes.
If we cannot resolve a dispute informally, any dispute arising from these Terms or TenderScan will be resolved through binding arbitration in accordance with the Arbitration Act (Ontario), rather than in court, except that you may assert claims in small claims court if your claims qualify.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on TenderScan before the changes take effect. Your continued use of TenderScan after the effective date of revised Terms constitutes your acceptance of the changes.
If you do not agree to the modified Terms, you must stop using TenderScan and cancel your account. Material changes will be effective no sooner than 30 days after we notify you.
